Terms of Service
Effective Date: November 5, 2026
Last Updated: November 5, 2026
1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and Sean McDow, an individual based in Albuquerque, New Mexico, United States ("Encore," "we," "us," or "our"), governing your use of the Encore mobile application and any related services (collectively, the "Service"). Once Encore is incorporated, these Terms will be updated to reflect the new operating entity and you will be notified of the change.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old and located in the United States to use Encore. By creating an account, you represent that you meet these requirements. We reserve the right to terminate accounts that we believe do not meet them.
If you are between 13 and the age of majority in your state, your parent or legal guardian should review these Terms with you.
3. Your Account
To use most features of Encore you need an account. If you sign up with email, you'll need to confirm your address before using Encore. You agree to:
- Provide accurate information when you sign up
- Keep your password confidential and not share your account with anyone
- Promptly notify us at support@encorelive.app if you suspect unauthorized access to your account
- Be responsible for all activity that occurs under your account
You may delete your account at any time from within the app (Profile & settings › Account & your data › Delete account), or as described at encorelive.app/delete-account. When you do, the consequences described in our Privacy Policy take effect.
We may suspend or terminate your account at our discretion for violations of these Terms, for behavior that harms other users, or for any other reason consistent with applicable law. We will use reasonable efforts to notify you of suspension or termination unless doing so would compromise an investigation or be otherwise inappropriate.
4. The Service
Encore helps you discover concerts, save events you are interested in, see what your friends are going to, message friends one-on-one and in group chats, keep ticket stubs from shows you've been to, and (where available) link out to ticket vendors to purchase tickets. The Service is provided free of charge at this time. We reserve the right to introduce paid features in the future; if we do, we will give you reasonable advance notice and you will not be charged without your express consent.
We may add, change, or discontinue features at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
4.1 Concert Information
Concert listings, including artists, venues, dates, ticket links, and prices, are gathered automatically from public sources. We do our best to keep this information accurate but we cannot guarantee accuracy. Always confirm event details with the venue or ticket vendor before traveling or making a purchase.
4.2 Ticket Purchases
When you tap a ticket link, your device opens the ticket seller's website in your browser. Where we can, that's the venue's own box office; otherwise it may be another ticketing company. The transaction is between you and the vendor. Encore is not the seller of any tickets and is not responsible for ticket purchases, refunds, event cancellations, or vendor service issues.
4.3 The Beta
Encore is in beta. Things will break, change or go away, and we may reset beta data while we fix problems. Don't rely on Encore for anything important yet. If you send us feedback (in the app or through TestFlight), we can use it to improve Encore, with no obligation to you.
5. Your Content and Conduct
5.1 Your Content
When you use Encore, you create content — your profile information, messages you send, concerts you save, friends you add, etc. ("Your Content"). You retain ownership of Your Content. By posting Your Content to the Service, you grant Encore a non-exclusive, worldwide, royalty-free license to host, store, transmit, and display it as needed to operate the Service and to keep it safe (for example, reviewing reports). This license ends when you delete the content or your account, except to the extent the content has already been received by other users (for example, messages already sent to a friend remain in that friend's chat history) and for copies kept in reports, as described in our Privacy Policy.
5.2 Prohibited Conduct
We have no tolerance for objectionable content or abusive users. You agree not to use Encore to:
- Violate any law or regulation
- Harass, threaten, intimidate, impersonate, or defame another user
- Post or send hateful, harassing, sexually explicit, or otherwise objectionable content
- Send unsolicited promotional messages, spam, or chain messages
- Attempt to gain unauthorized access to other accounts or to our backend systems
- Reverse engineer, decompile, or attempt to extract our source code (except as expressly permitted by law)
- Use automated tools (bots, scrapers, crawlers) to access or interact with the Service
- Sell, trade, or transfer your account
- Interfere with or disrupt the Service, including by introducing viruses, overloading our servers, or circumventing security features
- Collect or store personal information of other users without their consent
- Use the Service for any commercial purpose without our written permission
We may take action against accounts that violate this section, including content removal, account suspension, or termination, with or without notice.
5.3 Reporting Abuse
To report someone, open their profile and tap ⋯ › Report. If you've chatted with them, the last 20 messages of your chat go with the report so we can see what happened. They aren't told who reported them. You can block them from the same menu. You can also email support@encorelive.app with a description of the issue and any relevant screenshots. We will investigate reports promptly and take action where warranted.
We commit to:
- Reviewing reports of objectionable content within 24 hours of receipt
- Taking appropriate action, including content removal and user suspension where warranted
- Maintaining the ability for users to block other users they no longer wish to interact with
6. Intellectual Property
The Encore name, logo, app design, and all software, text, graphics, and other content provided by us (excluding Your Content and concert metadata gathered from public sources) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our intellectual property except as expressly permitted by these Terms or by applicable law.
We use third-party open source software in the Service. A list of those components and their licenses is available at https://encorelive.app/licenses.
7. Privacy
Our handling of your personal information is described in our Privacy Policy, which is incorporated by reference into these Terms.
8. Third-Party Services and Links
The Service may contain links to third-party websites or services (such as ticket vendors). We do not control these third parties and are not responsible for their content, services, or privacy practices. Your interactions with third parties are solely between you and them.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT CONCERT INFORMATION IS ACCURATE OR CURRENT.
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ENCORE OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (CURRENTLY $0, AS THE SERVICE IS FREE).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANYTHING ELSE THAT CANNOT BE LIMITED OR EXCLUDED BY LAW.
11. Indemnification
You agree to indemnify, defend, and hold Encore and its operators harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of another user or third party.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws rules.
If you have a problem with Encore, please email us first at support@encorelive.app; most things can be sorted out that way. Any dispute that can't be will be resolved in the state or federal courts located in Bernalillo County, New Mexico, and you and we consent to the personal jurisdiction of those courts.
You and we agree that any claim must be brought within one year after the cause of action arose; otherwise, the claim is permanently barred.
13. Apple App Store Additional Terms
If you obtained Encore through the Apple App Store or Apple TestFlight, the following additional terms apply:
- These Terms are between you and Encore only, not with Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support for the Service.
- If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
- Encore (not Apple) is responsible for addressing any claims by you or a third party relating to the Service, including product liability claims and intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Google Play Store Additional Terms
If you obtained Encore through the Google Play Store, your use of the Service is also subject to the Google Play Terms of Service. To the extent these Terms conflict with the Google Play Terms, the Google Play Terms govern with respect to your download of the Service from Google Play.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document and, for material changes, notify you within the app or by email. Your continued use of the Service after the update means you accept the revised Terms. If you do not agree with the revised Terms, you must stop using the Service and delete your account.
16. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account or your access to the Service at any time, with or without notice, for any reason consistent with applicable law, including violation of these Terms.
Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
17. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Encore concerning the Service and supersede any prior agreements.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
- Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. We may give you notices through the app, by email to the address associated with your account, or by posting to https://encorelive.app. You may give us notice at support@encorelive.app.
